Spotlight POS currently works with several models of ESC/POS thermal printers. Thermal printers have no ribbon and use thermal paper. We recommend the following thermal printer: Epson TM-T20 Ethernet-USB.Privacy and Information storage
Your personal secure data information is being stored on Google cloud servers which are undoubtedly the most credible and fast as we speak that are located in a physically secure data center. Your use of the Service is subject to and governed by this Spotlight Terms and Conditions Merchant Agreement ("Merchant Agreement") and the terms of any Spotlight Subscription Order Form (“Order Form”) that you entered that specifically references into this Merchant Agreement (collectively, the “Agreement”). We reserve the right to update and change the terms of this Agreement from time to time in our sole discretion. We will provide you with notice by updating this page and indicating the date of the update, so please check this page frequently for updates and changes. We also may send you notice via e-mail to the address associated with your Account. You agree you will be bound by the terms fourteen (14) days after notice, and your continued use of the service fourteen (14) days after notice shall constitute acceptance of the new terms by you going forward. You expressly agree that this notice protocol is sufficient and adequate for purposes of providing you notice of the revisions to this Agreement. If you refuse to be bound by the new terms, we reserve the right to terminate your Account and access to the Services in accordance with the termination provisions in Section 5. Any updates or changes made to this Agreement will not apply to you to the extent that: (1) the changes concern matters which are the subject of an actual dispute between you and Spotlight as of the date the changes take effect; and (2) we have actual notice of the dispute as of the date the changes take effect. The changes will not impact transactions that precede the date of the update.
You are responsible for maintaining control over access to your Account, including the confidentiality of your Account login and password, and are responsible for all activities that occur on or through your Account, whether authorized by you or not. If you create an Account as an individual acting as a representative of a corporation or other legal entity which wishes to use the Service, then you represent and agree that you have the authority to accept the Agreement on behalf of such corporation or other legal entity, and that all provisions of the Agreement will bind that corporation or other legal entity as if it were named in place of you.
You may establish subordinate accounts (“Sub-Accounts”) for the benefit of authorized personnel – such as employees or independent contractors. Sub-Accounts will be attached to and associated with your Account. You acknowledge and agree that Spotlight offers this feature purely as a convenience to you, and that you are exclusively responsible for ensuring that any person permitted to access a Sub-Account will do so only on your behalf (not, for example, for the person’s own purposes or the benefit of third parties) and that such person fully complies with this Agreement. You are fully responsible for managing access to, and security and confidentiality of such Sub-Accounts and agree to immediately notify Spotlight of any unauthorized use of such Sub-Accounts or any other breaches of your Account’s security.
The Service is billed in advance on a monthly basis and is non-refundable. There will be no refunds or credits for partial months of service, or refunds for months unused with an open account. In order to treat everyone equally, no exceptions will be made.
YOU ACKNOWLEDGE AND AGREE THAT YOU ASSUME ALL LEGAL AND FINANCIAL RESPONSIBILITY FOR ACTIVITY THAT OCCURS UNDER OR THOUGH YOUR ACCOUNT, INCLUDING ANY SUB-ACCOUNTS. Spotlight shall not be liable to you or to any other party for any losses or damages of any kind that result from: (1) your establishment and/or use of Accounts or Sub-Accounts; (2) for any activity or inactivity that occurs under any such Sub-Accounts attached to your Account, OR (3) your Account management, mismanagement, or lack of management of any and all Sub-Accounts attached to your Account.
If you created an Account on a free-trial basis and did not convert to a paid Account, we will suspend your Account and notify you by sending an email to your registered email address. If you do not respond to our notice within fifteen (15) days, (1) we will automatically close your Account; and (2) we may, but are not required to, delete information associated with the Account;
This Agreement becomes effective and binding on you when you create an Account. You may voluntarily terminate your Account at any time through the Account website or by contacting customer service at support@spotlightpos.com. You acknowledge and agree that if you terminate your Account before the end of a 30-day subscription cycle, or such subscription cycle as may apply, you will still be charged for the entire cycle. You acknowledge and agree that Spotlight shall not be obligated to issue any refunds, whether full, prorated, or otherwise, if you voluntarily terminate your Account before the end of a subscription cycle, regardless of whether you notify Spotlight.
You acknowledge and agree that Spotlight may terminate your access to the Service and your Account (including all attached Sub-Accounts): (a) if you breach or violate of any provision of this Agreement; (b) upon a request by law enforcement or other government agency; (c) upon your request to terminate your Account; (d) upon our decision to discontinue or materially modify all or any part of the Service or Payments; (e) upon the occurrence of technical or security issues as identified in Spotlight’s sole discretion; (f) if your use of the Service, whether through your Account or any Sub-Account or otherwise, is fraudulent or illegal; (g) for your non-payment of your Fees; (h) upon your violation of any other agreements you have with Spotlight; (i) for convenience upon sixty (60) days written notice; and/or (j) if we believe, in our sole discretion, that your continued use of the Service interferes with, is harmful to, or otherwise inconsistent with our business. If we terminate your access to the Service and/or your Account, we may, without limitation: (w) delete your Account and terminate your access to the Service and all information and features associated with your Account, unless otherwise agreed to in writing; (x) delete your password and all related information, files, and content associated with or inside your Account (or any part thereof); and (y) prohibit you from accessing the Service in the future through an alternative Account or otherwise. EXCEPT WITH RESPECT TO YOUR VOLUNTARY TERMINATION OF YOUR ACCOUNT, SPOTLIGHT SHALL MAKE ALL TERMINATION DECISIONS IN ITS SOLE DISCRETION AND SHALL IN NO EVENT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY TERMINATION OF YOUR ACCOUNT OR ACCESS TO THE SERVICE, INFORMATION IN OR ASSOCIATED WITH YOUR ACCOUNT OR ANY SUB-ACCOUNT, OR FOR ANY LOSSES OR DAMAGES OF ANY KIND RESULTING THEREFROM.
• Updates to Service. Spotlight may from time to time offer you updates and upgrades to its Service (“Updates”). The Updates may be critical or mandatory in nature and require you to download and install Updates in order to continue your access to the Service and your Account. Spotlight will attempt to give you reasonable notice of critical and mandatory Updates via Communications to the e-mail address or other contact information associated with your Account. IF YOU DO NOT DOWNLOAD AND INSTALL UPDATES, YOU AGREE SPOTLIGHT SHALL IN NO EVENT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INTERRUPTION, SUSPENSION OR TERMINATION OF YOUR ACCOUNT OR ACCESS TO THE SERVICE, INFORMATION ASOCIATED WITH YOUR ACCOUNT OR ANY SUB-ACCOUNT OR FOR ANY LOSSES OR DAMAGES OF ANY KIND RESULTING THEREFROM.
• Beta Testing. Spotlight may from time to time offer you the opportunity to participate in beta testing of new services, devices, software and features that have not been thoroughly tested for quality assurance. IF YOU ACCEPT AN OFFER BY SPOTLIGHT TO PARTICIPATE IN ANY BETA TESTING, YOU AGREE THAT SPOTLIGHT SHALL NOT BE LIABLE FOR ANY LOSSES OR DAMAGES OF ANY KIND THAT YOU MAY INCUR AS A RESULT OF SUCH PARTICIPATION, INCLUDING, WITHOUT LIMITATION, ANY INTERRUPTION OF THIRD PARTY SERVICES, OR LOSS OR DAMAGES TO YOUR COMPUTER(S), MOBILE, PERIPHERAL, OR OTHER DEVICES, OR LOSS OR DAMAGE TO DATA, INCLUDING TRANSACTION OR CARD INFORMATION, ASSOCIATED WITH AND IN YOUR ACCOUNT. YOU HEREBY WAIVE AND RELEASE SPOTLIGHT AND ITS AFFILIATES FROM ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THIS SECTION.
If you engage any third party to facilitate its obligations hereunder, you shall ensure that such third party implements and complies with reasonable security measures in handling any Customer Data. If any Customer Data is collected directly by you or a third party engaged by you, you shall ensure that you or such third party adopts, posts and processes the Customer Data in conformity with your posted privacy policy and all applicable laws.
You shall immediately notify Spotlight if you become aware of or suspect any unauthorized access to or use of Customer Data or any confidential information of Spotlight, and shall cooperate with Spotlight in the investigation of such breach and the mitigation of any damages. You will bear all associated expenses incurred by Spotlight to comply with applicable laws (including, but not limited to, any data breach laws) or arising from any unauthorized access or acquisition of Customer Data while such data is in your reasonable possession or control.
You acknowledge that we may collect and analyze information related to your interaction with and the operation of the Service, including, but not limited to, your time spent using the Service, browser types and language, Internet Protocol addresses, device-specific information, including your hardware model, operating system and version, unique device identifiers, mobile network information, information about the location of the device and the locations of our customers in relation to you and the device, the device's interaction and performance with our Service and customers, peripheral hardware and other Third Party Services.
Upon your agreement to be bound by the terms of the Agreement, Spotlight grants you a limited, non-exclusive, revocable, non-transferable, non-sub licensable license during the Term to use Spotlight's point of sale software application, related Services and related Customer Data on a mobile computer, tablet computer, or other device, solely for the purposes permitted by that software and Service in accordance with the terms of the Agreement, and to make one copy of the software for back-up purposes.
Spotlight owns all rights in and to the trademarks, service marks, logos, trade names, domain names, and social media identifiers ("Trademarks") used and displayed on or in connection with the Service, and you agree not to challenge, directly or indirectly, these entities' use, ownership, or registration of the Trademarks. You agree that nothing on the Sites or in this Agreement shall be construed as granting, in any way, any license or right to use any such Trademarks. Spotlight’s name, the Spotlight logo and the other Spotlight -formative trademarks may not be used in any way without prior written permission from Spotlight. Other product and company names mentioned on or in the Sites or Service may be the Trademarks of their respective owners.
You and us each agree that we shall bring any Dispute against the other in our respective individual capacities and not as a plaintiff or class member in any purported class, representative proceeding or as an association. In addition, you and us each agree that Disputes shall be arbitrated only on an individual basis and not in a class, consolidated or representative action. The arbitrator does not have the power to vary these provisions.
Notwithstanding anything to the contrary in this Agreement, either party may bring suit in court seeking an injunction or other equitable relief arising out of or relating to the infringement of a party’s intellectual property.
If for any reason a Dispute proceeds in court, you agree to submit to the personal jurisdiction of, and venue in, the courts of Justice law located in Cyprus with respect to any and all legal proceedings that may arise in connection with the Dispute, and waive any objection to such jurisdiction and venue. All parties irrevocably waive any and all rights they may have to a trial by jury in any judicial proceeding involving any claim relating to or arising under this agreement.

2. Account Creation, Activation and Security
You must create and activate a subscription account with Spotlight to receive the Service (“Account”). In order to create an Account, you must register and maintain a valid payment card or bank account to pay the monthly fee for the Service and provide information about your business, any authorized employees and other users, and any other data elements required by Spotlight. Once you have an established Account, you are solely responsible for your configuration and use of the Service.You are responsible for maintaining control over access to your Account, including the confidentiality of your Account login and password, and are responsible for all activities that occur on or through your Account, whether authorized by you or not. 3. Offline Mode
You must maintain an Internet connection ("Connection") to operate your Service and generally complete electronic transactions through your Service. If you temporarily lose your Connection, the Service may contain a feature that allows you to temporarily operate certain elements of the Service and maintain data relating thereto, to process the orders cloud sync, once your Connection is restored ("Offline Mode"). However, Offline mode contains inherent limitations. YOU ACKNOWLEDGE AND AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR AND ASSUME ALL LEGAL AND FINANCIAL RESPONSIBILITY FOR ACTIVITY THAT OCCURS DURING OFFLINE MODE, INCLUDING SERVICES, OPERATIONS, OR DATA IN CONNECTION WITH OFFLINE MODE THAT ARE INTERRUPTED, DAMAGED, OR LOST, REGARDLESS FOR THE REASON FOR, OR TIME OF, SUCH EVENT.4.Third Party Equipment and Services
Spotlight’s core service functionality under this Agreement is to deliver the Service, which may require you to integrate third party services, software, and devices (“Third Party Services”) to more robustly capitalize on the Service’s functionality. Specifically, in order to use the Service, you must supply certain equipment. You must have at least: (1) at least one Apple iPad®, iPod® Touch and iPhone® running the iOS version specified by Spotlight, (2) a working broadband Internet connection, (3) a secure wireless network available in all places within the venue where a Service-related device (including terminals as well as peripheral devices, such as any printers) will be used, and (4) an active Account. Spotlight prohibits and disclaims the use of the Service on any device that is modified contrary to the manufacturer’s software or hardware guidelines and your use of any such modified device constitutes a violation of this Agreement and grounds for us to terminate your Account.5. Monthly Service Fee; Termination
You agree to pay the applicable monthly fees listed in your Agreement. The Fees and any additional charges Spotlight levies under this Agreement may be deducted from any remittance you receive or are entitled to receive from Spotlight under the Agreement, charged to your credit card on file, deducted from your bank account on file, or otherwise paid or offset in connection with your Account. Unless otherwise agreed to in writing, your first Fees will be charged to you no later than thirty (30) days after you enter into this Agreement. Subject to this Agreement, we reserve the right to change our Fees, the payment schedule, and collection method in our sole and absolute discretion. If we change our Fees, billing schedule, or collection methods, we will notify you through your Account thirty (30) days in advance of the change (“Fees Change Notice Period”). If you do not agree to the Fees change, you must promptly close your Account and discontinue use of the Service prior to the last day of the Fees Change Notice Period. By continuing to use the Service after the last day of the Fees Change Notice Period, you accept the new Fees structure in its entirety.If you created an Account on a free-trial basis and did not convert to a paid Account, we will suspend your Account and notify you by sending an email to your registered email address. 6. Service Features
• Consent to E-Mail Communications. You acknowledge and agree that Spotlight may send any and all notifications and communications (“Communications”) to the email address associated with your Account, and it is your responsibility to keep the e-mail address associated with your Account current, valid and active. YOU ACKNOWLEDGE AND AGREE THAT ALL SUCH COMMUNICATIONS SHALL BE DEEMED TO BE “IN WRITING”, THAT YOU SHALL READ ALL SUCH COMMUNICATIONS, AND THAT YOU SHALL MAINTAIN APPROPRIATE RECORDS OF SUCH COMMUNICATIONS, AND SPOTLIGHT SHALL IN NO EVENT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOSSES OR DAMAGES OF ANY KIND RESULTING FROM YOUR FAILURE TO MAINTAIN A CURRENT, VALID AND ACTIVE E-MAIL ADDRESS IN CONNECTION WITH YOUR ACCOUNT OR FAILURE TO READ E-MAIL MESSAGES SENT THERETO.• Updates to Service. Spotlight may from time to time offer you updates and upgrades to its Service (“Updates”). 7. Technical Support
Spotlight may offer technical support with the Service, which may include, at our discretion, assistance with the setup of the Service and the peripheral hardware and software associated with certain features of the Service. You acknowledge and agree that Spotlight makes no guarantees that you will receive a timely response or any response at all to any technical support inquiries, or that the information or assistance you receive will be accurate or helpful.8. Content, Licenses and Ownership
"Customer Data" means all information about purchasers generated or collected by Spotlight, or you through the Service, including, but not limited to, purchasers' names, addresses, email addresses, phone numbers, purchaser preferences and tendencies, location, and reports and analytics relating thereto.If you engage any third party to facilitate its obligations hereunder, you shall ensure that such third party implements and complies with reasonable security measures in handling any Customer Data. You will bear all associated expenses incurred by Spotlight to comply with applicable laws (including, but not limited to, any data breach laws) or arising from any unauthorized access or acquisition of Customer Data while such data is in your reasonable possession or control.
You acknowledge that we may collect and analyze information related to your interaction with and the operation of the Service, including, but not limited to, your time spent using the Service, browser types and language, Internet Protocol addresses, device-specific information, including your hardware model, operating system and version, unique device identifiers, mobile network information, information about the location of the device and the locations of our customers in relation to you and the device, the device's interaction and performance with our Service and customers, peripheral hardware and other Third Party Services.
9. Intellectual Property; Copyright; Trademarks
Spotlight reserves all rights not expressly granted to you in the limited license granted to you by this Agreement. The Service, their contents, Application Usage Data, Customer Data, and any products or services provided or sold by Spotlight are the property of Spotlight, and are subject to the copyright or other intellectual property rights of the Spotlight service, and are protected by law. Any unauthorized reproduction; modification, distribution, transmission, republication, display or performance of Spotlight is strictly prohibited. You agree that nothing on or in the Service shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any copyrighted property displayed on or in the Spotlight service without the prior written permission of the copyright owner.Upon your agreement to be bound by the terms of the Agreement, Spotlight grants you a limited, non-exclusive, revocable, non-transferable, non-sub licensable license during the Term to use Spotlight's point of sale software application, related Services and related Customer Data on a mobile computer, tablet computer, or other device, solely for the purposes permitted by that software and Service in accordance with the terms of the Agreement, and to make one copy of the software for back-up purposes.
Spotlight owns all rights in and to the trademarks, service marks, logos, trade names, domain names, and social media identifiers ("Trademarks") used and displayed on or in connection with the Service, and you agree not to challenge, directly or indirectly, these entities' use, ownership, or registration of the Trademarks. You agree that nothing on the Sites or in this Agreement shall be construed as granting, in any way, any license or right to use any such Trademarks. Spotlight’s name, the Spotlight logo and the other Spotlight -formative trademarks may not be used in any way without prior written permission from Spotlight. Other product and company names mentioned on or in the Sites or Service may be the Trademarks of their respective owners.
10. Publicity and Feedback
By using the Service, you acknowledge and agree that Spotlight may display your business name or trademark on a customer list, whether on the Service or otherwise. You further acknowledge and agree that any ideas, suggestions, feedback, artwork, or other information or works (“Feedback”) that you make or develop in conjunction with your use of the Service or otherwise submit to Spotlight related to its business or the Service in any form, shall become the property of Spotlight.11. Force Majeure
You acknowledge and agree that Spotlight shall not be liable for any delay or failure to perform, including any disruptions or outages in the Service, resulting from causes outside the reasonable control of Spotlight, including without limitation Internet outages or interruptions, strikes, labor disputes, rebellions, revolutions, embargoes, earthquakes, fires, floods, wars, terrorism, riots, government sanctions, acts of God, acts of civil or military authorities, inability to secure raw materials, fuel, energy, labor, or transportation, and acts or omissions of carriers or suppliers.12. General
This Agreement constitutes the entire agreement between you and Spotlight relating to the Service and supersedes any and all other agreements, oral or in writing, with respect to the Service. Notwithstanding, in the event of a conflict between these terms and the terms of another agreement you enter into with Spotlight, the terms that shall control are, this Spotlight Merchant Agreement. Our failure to insist upon strict compliance with any term of this Agreement shall not be construed as a waiver with regard to any subsequent failure to comply with such term or provision. You acknowledge and agree that Spotlight may, without notice to or consent from you, assign, transfer or convey this Agreement, whether by direct assignment, change of control, operation of law or other transaction, to any third party, successor in interest, related party or affiliate of Spotlight (“Transferee”), and that such Transferee may rely upon your representations and enforce your obligations under this Agreement. In contrast, this Agreement is personal to you, and you may not assign your rights or obligations to anyone.You and us each agree that we shall bring any Dispute against the other in our respective individual capacities and not as a plaintiff or class member in any purported class, representative proceeding or as an association. In addition, you and us each agree that Disputes shall be arbitrated only on an individual basis and not in a class, consolidated or representative action. The arbitrator does not have the power to vary these provisions.
Notwithstanding anything to the contrary in this Agreement, either party may bring suit in court seeking an injunction or other equitable relief arising out of or relating to the infringement of a party’s intellectual property.
If for any reason a Dispute proceeds in court, you agree to submit to the personal jurisdiction of, and venue in, the courts of Justice law located in Cyprus with respect to any and all legal proceedings that may arise in connection with the Dispute, and waive any objection to such jurisdiction and venue. All parties irrevocably waive any and all rights they may have to a trial by jury in any judicial proceeding involving any claim relating to or arising under this agreement.
Πολιτική Προστασίας Προσωπικών Δεδομένων Σύμφωνα με τον Γενικό Κανονισμό Προστασίας Δεδομένων της ΕΕ (GDPR)
1. Σκοπός και πεδίο εφαρμογής
H εταιρία με την επωνυμία «SPOTLIGHTPOS HELLAS ΜΟΝΟΠΡΟΣΩΠΗ Ι.Κ.Ε», η οποία εδρεύει στην Αθήνα, επί της οδού Καρόρη αρ. 23, με Α.Φ.Μ 800590071, Δ.Ο.Υ ΦΑΕ Α’ Αθηνών (εφεξής η Εταιρία) λαμβάνει σοβαρά υπόψη την προστασία της ιδιωτικότητας των συναλλασσόμενων μαζί της. Για το λόγο αυτό ακολουθούμε με αυστηρότητα την ακόλουθη Πολιτική Προστασίας Προσωπικών Δεδομένων, η οποία διασφαλίζει το υψηλό επίπεδο των προσφερόμενων υπηρεσιών και τηρεί απαρέγκλιτα το ισχύον νομοθετικό πλαίσιο. Η παρούσα πολιτική αφορά φυσικά πρόσωπα που διενεργούν οιαδήποτε συναλλαγή με την Εταιρία, τους υπαλλήλους της, τους πελάτες της, καθώς και λοιπούς συνεργάτες. Τα δεδομένα προσωπικού χαρακτήρα των ως άνω φυσικών προσώπων συλλέγονται και διατηρούνται για τον απαραιτήτως αναγκαίο χρόνο, για καθορισμένους, ρητούς και νόμιμους σκοπούς, τυγχάνουν σύννομης και θεμιτής επεξεργασίας με διαφανή τρόπο σύμφωνα πάντα με το ισχύον νομικό πλαίσιο και κατά τρόπο που εγγυάται την ακεραιότητα και την εμπιστευτικότητα αυτών. Τα δεδομένα αυτά είναι κάθε φορά κατάλληλα, συναφή, πρόσφορα και όχι περισσότερα από όσα απαιτούνται εν όψει των ανωτέρω σκοπών, είναι δε ακριβή και, εφόσον χρειάζεται, υποβάλλονται σε ενημέρωση. Ρητά δηλώνεται ότι αυτή η πολιτική ισχύει για όλους τους υπαλλήλους, αντιπροσώπους και προμηθευτές της Εταιρείας, συμπεριλαμβανομένων και των εξωτερικών συνεργατών, και δημιουργεί ένα ελάχιστο πρότυπο επεξεργασίας δεδομένων προσωπικού χαρακτήρα καθώς επίσης ορίζει εφεξής και τις αρμοδιότητές τους.2. Περιεχόμενο 2.1. Νομική βάση
Η πολιτική αυτή είναι σύμφωνη με τον Γενικό Κανονισμό Προστασίας Δεδομένων της ΕΕ (ΓΚΠΔ) και το Νόμο 2472/1997 (ΦΕΚ 50/Α'/10.4.1997), καθώς και οποιονδήποτε εκτελεστικό νόμο του Γενικού Κανονισμού Προστασίας Δεδομένων τεθεί σε ισχύ στην ελληνική επικράτεια για την προστασία του ατόμου από την επεξεργασία προσωπικών δεδομένων, όπως τροποποιήθηκε και ισχύει, καθώς και με κάθε δευτερογενές δίκαιο / γνωμοδοτήσεις / αποφάσεις που εκδόθηκαν από την Ελληνική Αρχή Προστασίας Δεδομένων και οποιαδήποτε σχετική νομοθεσία.
2.2. Ορισμοί
Τα προσωπικά δεδομένα είναι πληροφορίες που μπορούν να σχετίζονται με ένα άτομο – φυσικό πρόσωπο. Τα δεδομένα θεωρούνται προσωπικά εάν ταυτοποιείται το πρόσωπο, το οποίο αφορούν.
Ειδικές κατηγορίες δεδομένων (επίσης γνωστές ως ευαίσθητα προσωπικά δεδομένα) αφορούν:
- α) Θρησκευτικές, φιλοσοφικές, πολιτικές ή συνδικαλιστικές απόψεις ή δραστηριότητες,
- β) την υγεία, γενετική ή βιομετρική πληροφόρηση, το συγγενικό περιβάλλον ή τη φυλετική και εθνική καταγωγή, δεδομένα σχετικά με τη σεξουαλική ζωή ενός ατόμου ή τον σεξουαλικό προσανατολισμό
- γ) ποινικές διαδικασίες και καταδίκες
Κατάρτιση προφίλ είναι μια συλλογή δεδομένων που επιτρέπει την εκτίμηση των χαρακτηριστικών ενός ατόμου και συνεπώς σημαντικών πτυχών της προσωπικότητάς του / της.
Παράδειγμα: Κατάρτιση προφίλ μπορεί να αποτελεί μια συλλογή δεδομένων, όπου συνδυάζονται διάφορες πληροφορίες, όπως οι κοινωνικές επαφές του ατόμου, οι πολιτικές και προσωπικές απόψεις, η οικονομική κατάσταση, η κατάσταση της υγείας και άλλες πληροφορίες, ώστε να προκύπτει μια ευρεία εικόνα για το υποκείμενο των δεδομένων.
Το υποκείμενο δεδομένων είναι φυσικό πρόσωπο στο οποίο αφορούν τα προσωπικά δεδομένα.
Η επεξεργασία δεδομένων είναι οποιαδήποτε δραστηριότητα που περιλαμβάνει προσωπικά δεδομένα, ανεξάρτητα από τα μέσα και τη διαδικασία που εφαρμόζεται, π.χ. η συλλογή, αποθήκευση, χρήση, αναθεώρηση, αποκάλυψη, αρχειοθέτηση, προβολή και καταστροφή προσωπικών δεδομένων.
Ως αρχείο δεδομένων νοείται κάθε απόθεμα προσωπικών δεδομένων που είναι διαρθρωμένο κατά τρόπο που να επιτρέπει την ταυτοποίηση του εν λόγω προσώπου από τα δεδομένα. Π.χ. οποιοδήποτε εργαλείο πληροφορικής που περιέχει προσωπικά δεδομένα.
Ως διαβίβαση νοείται η πρόσβαση στα προσωπικά δεδομένα, για παράδειγμα επιτρέποντας πρόσβαση, μετάδοση ή δημοσίευση.
Η εκτίμηση αντικτύπου στα προσωπικά δεδομένα είναι μια συστηματική διαδικασία για τον εντοπισμό, την αξιολόγηση και την τεκμηρίωση των κινδύνων και των επιπτώσεων των δραστηριοτήτων επεξεργασίας δεδομένων προσωπικού χαρακτήρα.
Ο υπεύθυνος επεξεργασίας είναι το νομικό πρόσωπο που αποφασίζει για το σκοπό, το περιεχόμενο και τη διαδικασία επεξεργασίας δεδομένων προσωπικού χαρακτήρα.
Ο εκτελών την επεξεργασία είναι ένα φυσικό ή νομικό πρόσωπο που επεξεργάζεται δεδομένα προσωπικού χαρακτήρα σύμφωνα με τις οδηγίες του υπεύθυνου επεξεργασίας δεδομένων.
2.3. Γενικές υποχρεώσεις κατά την επεξεργασία προσωπικών δεδομένων
2.3.1. Αρχές επεξεργασίας δεδομένων
Κάθε πρόσωπο που επεξεργάζεται δεδομένα προσωπικού χαρακτήρα πρέπει να συμμορφώνεται με τις ακόλουθες αρχές.
2.3.1.1. Νόμιμη επεξεργασία
Τα προσωπικά δεδομένα μπορούν να υποβάλλονται σε επεξεργασία αποκλειστικά με νόμιμο τρόπο. Ο εκτελών την επεξεργασία πρέπει να διασφαλίζει τη συμμόρφωση με την παρούσα πολιτική και τους σχετικούς νόμους και κανονισμούς.
2.3.1.2. Συναίνεση - Συγκατάθεση
Πριν από την επεξεργασία των δεδομένων προσωπικού χαρακτήρα, το υποκείμενο των δεδομένων πρέπει να ενημερώνεται και να δίνει τη συγκατάθεσή του οικειοθελώς. Η συγκατάθεση μπορεί να δίδεται ρητά ή σιωπηρά, π.χ. με την παροχή προσωπικών δεδομένων στον υπεύθυνο επεξεργασίας δεδομένων. Η συγκατάθεση δεν χρειάζεται απαραίτητα να είναι γραπτή, ωστόσο, προκειμένου να αποδεικνύεται η συναίνεση (π.χ. προς δικαστήρια και αρχές), συνιστάται γραπτή συγκατάθεση ή επιτρεπόμενη καταγραφή κλήσεων. Το υποκείμενο των δεδομένων μπορεί να αποσύρει τη συγκατάθεσή του ανά πάσα στιγμή.
Δεν απαιτείται συγκατάθεση στις ακόλουθες περιπτώσεις:
- εάν το υποκείμενο των δεδομένων έχει γενικά καταστήσει τα προσωπικά του δεδομένα δημόσια προσβάσιμα, π.χ. πληροφορίες που δίδονται σε εφημερίδα ή τηλεφωνικούς καταλόγους, και δεν έχει απαγορεύσει την επεξεργασία τους,
- για την εκτέλεση σύμβασης στην οποία το υποκείμενο των δεδομένων είναι συμβαλλόμενο μέρος,
- προκειμένου να ληφθούν μέτρα σχετικά με το αίτημα του υποκειμένου των δεδομένων πριν από τη σύναψη της σύμβασης,
- για τη συμμόρφωση με τις νομικές υποχρεώσεις του υπεύθυνου επεξεργασίας δεδομένων,
- για την προστασία των ζωτικών συμφερόντων του υποκειμένου των δεδομένων ή άλλου φυσικού προσώπου,
- εάν τα νόμιμα συμφέροντα που επιδιώκει Εταιρεία ή τρίτος υπερισχύουν των δικαιωμάτων του προσώπου, στο οποίο αναφέρονται τα δεδομένα, εκτός εάν τα εν λόγω συμφέροντα υπερισχύουν των θεμελιωδών δικαιωμάτων και ελευθεριών του υποκειμένου των δεδομένων.
2.3.1.4 Σκοπός επεξεργασίας
Τα προσωπικά δεδομένα μπορούν να υποβάλλονται σε επεξεργασία μόνο για τον σκοπό που υποδεικνύεται κατά τη στιγμή της συλλογής, ή για το σκοπό που προβλέπεται από το νόμο. Βλέπε, επίσης, την παράγραφο 2.3.1.2 σχετικά με τη συγκατάθεση.
Η επεξεργασία των προσωπικών δεδομένων πρέπει να γίνεται με καλή πίστη και τα δεδομένα που συλλέγονται ή αποθηκεύονται πρέπει να είναι απαραίτητα για την εκπλήρωση του σκοπού της επεξεργασίας τους.
Κάθε πρόσωπο που επεξεργάζεται δεδομένα είναι υπεύθυνο να διασφαλίσει ότι η επεξεργασία είναι νόμιμη και συνεπής με το σκοπό για τον οποίο συλλέχθηκαν τα δεδομένα.
2.3.1.5 Αρχεία προσωπικού
Ο φάκελος προσωπικού και τα προσωπικά δεδομένα που αφορούν τους υπαλλήλους της Εταιρείας ταξινομούνται ως «εμπιστευτικές» πληροφορίες.
Οι υπάλληλοι των εταιρειών της Εταιρείας μπορούν να ελέγξουν τον ατομικό τους φάκελο και να ζητήσουν πληροφορίες σχετικά με άλλα προσωπικά δεδομένα που τους αφορούν. Το αίτημα πληροφόρησης ή ελέγχου μπορεί να υποβληθεί προφορικά ή γραπτά.
2.3.1.6 Ποιότητα δεδομένων
Κάθε πρόσωπο που επεξεργάζεται προσωπικά δεδομένα πρέπει να διασφαλίζει ότι τα δεδομένα είναι ορθά και πλήρη.
Η Εταιρεία πρέπει να λαμβάνει κάθε τεχνικό και οργανωτικό μέτρο, προκειμένου να διασφαλίσει ότι τα προσωπικά δεδομένα, που είναι λανθασμένα ή ελλιπή, διορθώνονται ή καταστρέφονται.
2.3.1.7 Διαβίβαση σε τρίτους
Τα δεδομένα προσωπικού χαρακτήρα αποκαλύπτονται σε τρίτους μόνον εφόσον είναι απαραίτητο. Τα δεδομένα προσωπικού χαρακτήρα πρέπει να παρέχονται ανωνύμως, εφόσον κρίνεται σκόπιμο.
Τρίτος εκτελών την επεξεργασία για λογαριασμό της Εταιρείας, π.χ. ένας εργολάβος ή πάροχος υπηρεσιών, πρέπει να συμφωνήσει συμβατικά για την επεξεργασία προσωπικών δεδομένων σύμφωνα με την παρούσα πολιτική. Οι όροι αυτής της πολιτικής συμπεριλαμβάνονται με παραπομπή στις σχετικές συμβάσεις.
2.3.1.8 Διασυνοριακή αποκάλυψη προσωπικών δεδομένων
Τα δεδομένα προσωπικού χαρακτήρα αποκαλύπτονται στο εξωτερικό μόνο εάν ο αλλοδαπός νόμος προβλέπει επαρκές επίπεδο προστασίας των δεδομένων. Σε περίπτωση που ο αλλοδαπός νόμος δεν παρέχει επαρκές επίπεδο προστασίας δεδομένων, τα δεδομένα προσωπικού χαρακτήρα μπορούν να μεταφερθούν σε αυτή τη χώρα μόνον εάν το πρόσωπο στο οποίο αναφέρονται τα δεδομένα έχει συναινέσει ρητά στη μεταφορά ή εάν η προστασία δεδομένων προβλέπεται από την κατάλληλη συμφωνία περί μεταφοράς δεδομένων.
2.3.1.9 Ασφάλεια των Δεδομένων
Η Εταιρεία θα λαμβάνει το κατάλληλο προσωπικό, τεχνικά και οργανωτικά μέτρα για την ελαχιστοποίηση του κινδύνου ακούσιας ή σκόπιμης παραβίασης, καταστροφής ή απώλειας προσωπικών δεδομένων.
Συγκεκριμένα, η Εταιρεία θα λαμβάνει διασφαλίσεις για την προστασία των προσωπικών δεδομένων από μη εξουσιοδοτημένη πρόσβαση και επεξεργασία. Με τον τρόπο αυτό θα ληφθούν υπόψη οι τεχνολογικές καινοτομίες και θα καθοριστούν διαδικασίες ασφαλείας προσαρμοσμένες στις ιδιαιτερότητες της επεξεργασίας.
Επιπλέον, η Εταιρία έχει λάβει τα κατάλληλα τεχνικά κα οργανωτικά μέτρα προκειμένου να διασφαλίζεται η εφαρμογή της νομοθεσίας και το κατάλληλο επίπεδο ασφάλειας των προσωπικών δεδομένων των φυσικών προσώπων και έχει εκπαιδεύσει προσηκόντως το προσωπικό της και δεσμεύει όλους τους συνεργάτες του, οι οποίοι ενεργούν για λογαριασμό του ως Εκτελούντες την Επεξεργασία με συμβάσεις που διέπονται από τα εχέγγυα και τις διασφαλίσεις του ΓΚΠΔ.
Συμπερασματικά:
Σύμφωνα με το ανωτέρω νομικό πλαίσιο, η Εταιρία συλλέγει και επεξεργάζεται προσωπικά δεδομένα φυσικών προσώπων για τους κατωτέρω σκοπούς και μόνο στο απολύτως αναγκαίο μέτρο για την αποτελεσματική εξυπηρέτηση των σκοπών αυτών. Τα δεδομένα αυτά είναι κάθε φορά συναφή, πρόσφορα και όχι περισσότερα από όσα απαιτούνται εν όψει των κατωτέρω σκοπών, είναι δε ακριβή και, εφόσον χρειάζεται, υποβάλλονται σε ενημέρωση-επικαιροποίηση. Η Εταιρία δύναται να επεξεργάζεται δεδομένα προσωπικού χαρακτήρα, εφόσον η επεξεργασία είναι απαραίτητη για μία τουλάχιστον από τις ακόλουθες νομικές βάσεις, ήτοι :
- Για την εκτέλεση της μεταξύ μας σύμβασης, ή
- προκειμένου να συμμορφωθεί σε έννομη υποχρέωσή της, ή
- για τους σκοπούς των εννόμων συμφερόντων της, ή
- για την εκπλήρωση καθήκοντος που εκτελείται προς το δημόσιο συμφέρον
Ενδεικτικά:
- Η Εταιρία διατηρεί και επεξεργάζεται τα προσωπικά δεδομένα που της παρέχει ένας Συνεργάτης της, με σκοπό την εξυπηρέτηση, υποστήριξη και παρακολούθηση των συναλλακτικών του σχέσεων με την Εταιρία, την εξέταση και ικανοποίηση αιτημάτων και την άσκηση των νόμιμων και συμβατικών της δικαιωμάτων.
- Η Εταιρία, σύμφωνα με όσα προβλέπονται στο υφιστάμενο νομικό πλαίσιο, έχει έννομη υποχρέωση, καθώς και κατά περίπτωση καθήκον προς το δημόσιο συμφέρον να διαβιβάζει κάθε είδους δεδομένου προσωπικού χαρακτήρα που αφορούν τα ως άνω φυσικά πρόσωπα των οποίων τα δεδομένα επεξεργάζεται, στις αρμόδιες αστυνομικές, δικαστικές, διοικητικές, φορολογικές Αρχές εντός και εκτός Ευρωπαϊκής Ένωσης, κατόπιν έγκυρου αιτήματος αυτών, χωρίς πρότερη ενημέρωσή τους. Επίσης, έχει έννομη υποχρέωση να πραγματοποιεί κάθε απαραίτητο εσωτερικό έλεγχο σε δεδομένα προσωπικού χαρακτήρα που τα αφορούν, σύμφωνα με τις εσωτερικές της διαδικασίες, όταν κατά νόμο προβλέπεται ή ορίζεται.
- Η Εταιρία, σύμφωνα με όσα προβλέπονται στο υφιστάμενο νομικό πλαίσιο, δύναται να διαβιβάζει τα δεδομένα προσωπικού χαρακτήρα για την εκτέλεση και εκκαθάριση των συμβάσεων και για τη διαφύλαξη των εννόμων συμφερόντων της ως προς την είσπραξη και εξόφληση των οφειλών που έχουν προκύψει, σε δικηγορικά γραφεία.
- Η Εταιρία, σύμφωνα με όσα προβλέπονται στο υφιστάμενο νομικό πλαίσιο, για την προστασία της εμπορικής πίστης και των οικονομικών συναλλαγών, δύναται να διαβιβάζει τα δεδομένα που έχουν σχέση με την οικονομική συμπεριφορά των φυσικών προσώπων, των οποίων τα δεδομένα επεξεργάζεται, τον έλεγχο φερεγγυότητάς τους και την αναζήτηση δεδομένων της οικονομικής συμπεριφοράς τους (π.χ. από το διατραπεζικό αρχείο της ΤΕΙΡΕΣΙΑΣ ΑΕ).
- Η Εταιρία κατόπιν σχετικής θετικής συγκαταθέσεώς σας, δύναται να επεξεργάζεται τα δεδομένα προσωπικού χαρακτήρα που σας αφορούν με σκοπό την ανάπτυξη, βελτίωση και προώθηση των υπηρεσιών της.
2.3.1.10 Αποθήκευση και διατήρηση δεδομένων
Η Εταιρία διατηρεί τα δεδομένα προσωπικού χαρακτήρα των φυσικών προσώπων για όσο χρονικό διάστημα προβλέπεται ανά περίπτωση, από το εκάστοτε ισχύον νομοθετικό και κανονιστικό πλαίσιο και σε κάθε περίπτωση για χρονικό διάστημα είκοσι (20) από την τελευταία ημερολογιακή ημέρα του έτους λήξης της εκάστοτε συναλλακτικής σας σχέσης με την Εταιρία. Σε περίπτωση που οποιοδήποτε αίτημα συνεργασίας σας με την Εταιρία δεν γίνει αποδεκτό, τα δεδομένα θα τηρούνται για χρονικό διάστημα πέντε (5) ετών. Σε περίπτωση δικαστικής αντιδικίας τα προσωπικά δεδομένα που σας αφορούν θα τηρούνται μέχρι τη λήξη της εκκρεμοδικίας ακόμα και σε περίπτωση υπέρβασης του ανώτερου χρονικού διαστήματος των είκοσι (20) ετών.
2.3.2 Δικαιώματα των υποκειμένων των δεδομένων
Κάθε υποκείμενο δεδομένων έχει τα ακόλουθα δικαιώματα σύμφωνα με το ΓΚΠΔ:
- α) Το δικαίωμα ενημέρωσης,
- β) Το δικαίωμα πρόσβασης,
- γ) Το δικαίωμα διόρθωσης,
- δ) Το δικαίωμα διαγραφής,
- ε) Το δικαίωμα περιορισμού της επεξεργασίας,
- στ) Το δικαίωμα στη φορητότητα δεδομένων,
- ζ) Το δικαίωμα αντίρρησης,
- η) Δικαιώματα σχετικά με την αυτοματοποιημένη λήψη αποφάσεων και τη δημιουργία προφίλ.
Η νομοθεσία για την προστασία των προσωπικών δεδομένων παρέχει στα φυσικά πρόσωπα τα ως άνω δικαιώματα, τα οποία μπορούν να ασκήσουν και με βάση όσα προβλέπονται στο νομικό πλαίσιο.
Αναλυτικά:
- Δικαίωμα πρόσβασης, ήτοι να ενημερώνονται για το ποια δεδομένα τους έχει συλλέξει και υφίστανται επεξεργασία από την Εταιρία, την προέλευσή τους, τους σκοπούς και τη νομική βάση επεξεργασίας αυτών, τους τυχόν αποδέκτες ή τις κατηγορίες αποδεκτών των προσωπικών δεδομένων, ιδίως σε τρίτες χώρες καθώς και το χρόνο τήρησης τους
- Δικαίωμα διόρθωσης τυχόν ανακριβών προσωπικών δεδομένων τους, ώστε να καταστούν ακριβή, υποβάλλοντας στην Εταιρία σχετική δήλωση με τα ακριβή προσωπικά δεδομένα τους
- Δικαίωμα συμπλήρωσης τυχόν ελλιπών προσωπικών δεδομένων τους, ώστε να καταστούν πλήρη, υποβάλλοντας στην εταιρία σχετική δήλωση με τα πλήρη προσωπικά δεδομένα τους
- Δικαίωμα διαγραφής των προσωπικών τους δεδομένων στις εξής περιπτώσεις :
- i. όταν τα προσωπικά τους δεδομένα δεν είναι πλέον απαραίτητα σε σχέση με τους σκοπούς για τους οποίους συλλέχθηκαν ή υποβλήθηκαν κατ’ άλλο τρόπο σε επεξεργασία,
- ii. όταν ανακαλούν τη συγκατάθεση σας επί της οποίας βασίσθηκε η επεξεργασία των προσωπικών δεδομένων σας και δεν υπάρχει άλλη νομική βάση για την επεξεργασία.
- iii. όταν τα προσωπικά δεδομένα τουε υποβλήθηκαν σε επεξεργασία χωρίς την ύπαρξη της απαραίτητης νομικής βάσης,
- iv. προβλέπεται από το νόμο η υποχρέωση διαγραφής των προσωπικών δεδομένων σας,
- v. όταν έχουν συλλεγεί με τη προσφορά υπηρεσιών της κοινωνίας των πληροφοριών προσωπικά δεδομένα παιδιού, κατόπιν συγκατάθεσης του προσώπου που έχει τη γονική μέριμνα του παιδιού
- Δικαίωμα περιορισμού της επεξεργασίας των προσωπικών δεδομένων τους, στις εξής περιπτώσεις : i. αμφισβητείται η ακρίβεια των προσωπικών δεδομένων τους και μέχρι να επαληθεύσει η Εταιρεία την ακρίβεια τους, ii. όταν αντί της διαγραφής, ζητείται ο περιορισμός της επεξεργασίας των προσωπικών δεδομένων τους, iii. Όταν η Εταιρεία δεν χρειάζεται πλέον τα προσωπικά δεδομένα τους για τους σκοπούς επεξεργασίας, αλλά τα προσωπικά δεδομένα αυτά απαιτούνται από εσάς για τη θεμελίωση, την άσκηση ή την υποστήριξη νομικών αξιώσεων
- Δικαίωμα εναντίωσης – αντίταξης στην επεξεργασία των δεδομένων τους, εκτός εάν υφίστανται επιτακτικοί και νόμιμοι λόγοι για την επεξεργασία, οι οποίοι υπερισχύουν των συμφερόντων, των δικαιωμάτων και των ελευθεριών τους ή για τη θεμελίωση, άσκηση ή υποστήριξη νομικών αξιώσεων της Εταιρείας,
- Δικαίωμα φορητότητας, ήτοι να λάβουν και να διαβιβάσουν σε άλλον υπεύθυνο επεξεργασίας τα προσωπικά δεδομένα τους, τα οποία έχουν παράσχει στην Εταιρία σε κατάλληλο μορφότυπο, εφόσον η επεξεργασία των προσωπικών δεδομένων τους έχει λάβει χώρα κατόπιν συγκατάθεσής σας ή υπήρξε απαραίτητη για την εκτέλεση της μεταξύ ημών σύμβασης
- Δικαίωμα να ανακαλέσουν ανά πάσα στιγμή τη συγκατάθεση (χωρίς αναδρομική ισχύ) που έχουν παράσχει για ζήτημα σχετιζόμενο με την προστασία απλών προσωπικών δεδομένων.
Τα εν λόγω δικαιώματα μπορεί να περιοριστούν λόγω υποχρέωσης εφαρμογής άλλου νόμου, όπως για παράδειγμα στην περίπτωση που αιτηθείτε τη διαγραφή δεδομένων, ενώ η Εταιρία υποχρεούται να τα διατηρήσει βάσει νόμου. Για όλα τα ανωτέρω και για την επίλυση οιασδήποτε απορίας αναφορικά με την ισχύουσα νομοθεσία για τα προσωπικά δεδομένα, μπορείτε να επικοινωνήσετε με την Εταιρία μας ως στην ηλεκτρονική της διεύθυνση: info@spotlightpos.com. Η Εταιρία θα απαντήσει στην ως άνω Αίτηση, σε κάθε περίπτωση εντός μηνός από την παραλαβή του αιτήματος, εκτός εξαιρετικών περιπτώσεων, οπότε η ανωτέρω προθεσμία μπορεί να παραταθεί κατά δυο ακόμη μήνες, εφόσον απαιτείται, λαμβανομένων υπόψη της πολυπλοκότητας του αιτήματος ή και του αριθμού των αιτημάτων. Η Εταιρία θα ενημερώσει τα φυσικά πρόσωπα για τυχόν παράταση εντός μηνός από την παραλαβή του αιτήματος, καθώς και για τους λόγους της καθυστέρησης. Εάν δεν καθίσταται δυνατή η ικανοποίηση του αιτήματος τους, η Εταιρία θα ενημερώσει τα φυσικά πρόσωπα χωρίς καθυστέρηση και το αργότερο εντός μηνός από την παραλαβή του αιτήματος, για τους σχετικούς λόγους και για τη δυνατότητα να υποβάλλουν καταγγελία στην Αρχή Προστασίας Δεδομένων Προσωπικού Χαρακτήρα, καθώς και για το δικαίωμα τους να προσφύγετε ενώπιον των αρμόδιων δικαστικών αρχών. Επίσης, σε περίπτωση που θεωρείται ότι προσβάλλονται τα δικαιώματά των φυσικών προσώπων που αφορούν στην προστασία των προσωπικών σας δεδομένων διατηρείτε το δικαίωμα υποβολής καταγγελίας στην Αρχή Προστασίας Δεδομένων Προσωπικού Χαρακτήρα (Λ. 2.3.3 Καταγραφή παραβίασης δεδομένων
Κάθε παράβαση αυτής της πολιτικής, των σχετικών νόμων και κανονισμών προστασίας δεδομένων συνιστά παραβίαση προσωπικών δεδομένων. Ενδεικτικά συμβάντα είναι η παράνομη καταστροφή, απώλεια, αλλοίωση, η μη εξουσιοδοτημένη αποκάλυψη, καθώς και η επεξεργασία δεδομένων χωρίς συναίνεση ή για σκοπούς άλλους από εκείνους που υποδεικνύονται τη στιγμή της συλλογής.
Το πρόσωπο που ανακαλύπτει την παραβίαση προσωπικών δεδομένων λαμβάνει τα κατάλληλα μέτρα για την προστασία των προσωπικών δεδομένων από περαιτέρω επιπτώσεις και αναφέρει την παραβίαση στην Διοίκηση της Εταιρείας και το Νομικό Τμήμα της Εταιρείας χωρίς καθυστέρηση.
Το Νομικό Τμήμα συστηματικά καταγράφει τις παραβιάσεις που του αποκαλύφθηκαν και αξιολογεί τους λόγους των παραβιάσεων. Επιπλέον, το Νομικό Τμήμα λαμβάνει περαιτέρω απαιτούμενα μέτρα για την αποκατάσταση της κατάστασης και την αποτροπή της επανάληψης των παραβιάσεων. 2.3.4 Ειδοποίηση για παραβίαση δεδομένων
Η Εταιρεία πρέπει να ειδοποιήσει την αρμόδια εποπτική αρχή για την παραβίαση δεδομένων εντός 72 ωρών από τη στιγμή που λαμβάνει γνώση.
Επιπλέον, εάν η παραβίαση των προσωπικών δεδομένων είναι πιθανό να θέσει σε υψηλό κίνδυνο τα δικαιώματα και τις ελευθερίες του υποκειμένου των δεδομένων, το υποκείμενο των δεδομένων πρέπει να ενημερώνεται χωρίς καθυστέρηση. 2.3.5 Κατάρτιση και ευαισθητοποίηση
Κάθε υπάλληλος της Εταιρείας εκπαιδεύεται σε θέματα προστασίας δεδομένων και ασφάλειας δεδομένων. Μια πρώτη εκπαιδευτική συνεδρία θα ακολουθήσει κατά την έναρξη της απασχόλησης εντός της Εταιρείας και οι επακόλουθες εκπαιδεύσεις θα πραγματοποιούνται σε τακτά χρονικά διαστήματα.
2.4 Υποχρεώσεις για την ανάπτυξη συστημάτων και νέων επιχειρηματικών διαδικασιών
Η προστασία δεδομένων αποτελεί αναπόσπαστο μέρος της τεχνολογικής ανάπτυξης και της οργανωτικής δομής της Εταιρείας. Κατά συνέπεια, πρέπει να λαμβάνονται υπόψη οι ακόλουθες αρχές όταν αξιολογούνται οι τρέχουσες επιχειρηματικές διαδικασίες ή τα συστήματα επεξεργασίας δεδομένων ή όταν εισάγονται νέα.
Οι υπάλληλοι της Εταιρείας οφείλουν να σέβονται το αίτημα πρόσβασης του υποκειμένου των δεδομένων. 2.5. Υπεύθυνος επεξεργασίας δεδομένων
Ο υπεύθυνος επεξεργασίας δεδομένων, ο οποίος αναμένεται να υπάρχει στις περισσότερες περιπτώσεις της Εταιρείας, είναι υπεύθυνος για την ορθή επεξεργασία των προσωπικών δεδομένων και την τήρηση των απαιτήσεων προστασίας δεδομένων και ασφάλειας δεδομένων όπως ορίζεται στην παρούσα πολιτική ή σύμφωνα με την ισχύουσα νομοθεσία. Συγκεκριμένα, για:
- α) την τήρηση των αρχών «προστασία των δεδομένων από τον σχεδιασμό» και «προστασία των δεδομένων εξ ορισμού» κατά την ανάπτυξη νέων δραστηριοτήτων επεξεργασίας δεδομένων,
- β) τη σωστή κατανομή των δικαιωμάτων των υποκειμένων των δεδομένων,
- γ) διεξαγωγή εκτιμήσεων αντικτύπου για την προστασία των προσωπικών δεδομένων με τη βοήθεια του υπεύθυνου προστασίας δεδομένων,
- δ) διορίζει τον εκτελούντα την επεξεργασία,
- ε) την κοινοποίηση παραβίασης των προσωπικών δεδομένων στην εποπτική αρχή και στο υποκείμενο των δεδομένων (κατά περίπτωση).
2.5.1 Ο εκτελών την επεξεργασία
Ο εκτελών την επεξεργασία είναι υπεύθυνος για την επεξεργασία των προσωπικών δεδομένων σύμφωνα με τις οδηγίες που λαμβάνει από τον υπεύθυνο επεξεργασίας δεδομένων. Επιπλέον, ο εκτελών την επεξεργασία είναι υπεύθυνος να ενημερώνει χωρίς αδικαιολόγητη καθυστέρηση τον υπεύθυνο επεξεργασίας δεδομένων σχετικά με την παραβίαση της προστασίας δεδομένων.
Ο εκτελών την επεξεργασία πρέπει να επιτρέπει συμβατικά σε οποιονδήποτε ενδεχόμενο υπεργολάβο, που λαμβάνει εντολή να εκτελέσει την επεξεργασία δεδομένων, να συμμορφώνεται με τις ίδιες οδηγίες που λαμβάνει από τον υπεύθυνο επεξεργασίας δεδομένων.
2.5.2 Εκτελεστική διοίκηση
Η εκτελεστική διοίκηση της Εταιρείας είναι υπεύθυνη για την εφαρμογή αυτής της πολιτικής και πρέπει να παρέχει το απαραίτητο προσωπικό και τους οικονομικούς πόρους. Οι managers της Εταιρείας υποχρεούνται να εφαρμόζουν την πολιτική στον τομέα ευθύνης τους και να διασφαλίζουν ότι οι υπάλληλοι, τα άτομα και οι οντότητες για τις οποίες είναι υπεύθυνοι γνωρίζουν, κατανοούν και τηρούν τις απαιτήσεις αυτής της πολιτικής και είναι κατάλληλα εκπαιδευμένοι να εκπληρώσουν πλήρως αυτό το καθήκον τους.
2.6 Παραβίαση της πολιτικής προστασίας δεδομένων
Οι πιθανές κυρώσεις και ζημίες που απορρέουν από την παραβίαση προστασίας δεδομένων είναι σοβαρές τόσο για το πρόσωπο που διαπράττει την παραβίαση όσο και για την Εταιρεία.
Κάθε παραβίαση αυτής της πολιτικής προστασίας δεδομένων μπορεί να οδηγήσει σε πειθαρχικές κυρώσεις έως και την απόλυση. Οι παραβιάσεις νομικών ή κανονιστικών υποχρεώσεων μπορούν να αναφέρονται σε εξωτερικές αρχές και μπορεί να έχουν ως αποτέλεσμα ποινικές, αστικές ή κανονιστικές κυρώσεις.
Η Εταιρεία διατηρεί το δικαίωμα να τροποποιεί και να αναπροσαρμόζει την παρούσα Πολιτική, όποτε κρίνει αυτό αναγκαίο, ενώ οι εκάστοτε αλλαγές τίθενται σε ισχύ από την αποστολή αυτών στο ηλεκτρονικό ταχυδρομείο των ως άνω φυσικών προσώπων.
- i. όταν τα προσωπικά τους δεδομένα δεν είναι πλέον απαραίτητα σε σχέση με τους σκοπούς για τους οποίους συλλέχθηκαν ή υποβλήθηκαν κατ’ άλλο τρόπο σε επεξεργασία,
- ii. όταν ανακαλούν τη συγκατάθεση σας επί της οποίας βασίσθηκε η επεξεργασία των προσωπικών δεδομένων σας και δεν υπάρχει άλλη νομική βάση για την επεξεργασία.
- iii. όταν τα προσωπικά δεδομένα τουε υποβλήθηκαν σε επεξεργασία χωρίς την ύπαρξη της απαραίτητης νομικής βάσης,
- iv. προβλέπεται από το νόμο η υποχρέωση διαγραφής των προσωπικών δεδομένων σας,
- v. όταν έχουν συλλεγεί με τη προσφορά υπηρεσιών της κοινωνίας των πληροφοριών προσωπικά δεδομένα παιδιού, κατόπιν συγκατάθεσης του προσώπου που έχει τη γονική μέριμνα του παιδιού
